Resolution together – one solicitor – one couple – one outcome
When a marriage breaks down it is never easy. There is a lot to think about at a time when you may also be dealing with your own emotions and worries about the future.
When looking to go your own separate ways there are lots of different routes you can choose to work things out. Although court proceedings can be an important element in certain circumstances, they are not always required.
What is important is that you find the best way that helps you to reach an outcome that works for you.
What is Resolution Together?
New legislation introduced on the 6 April 2022 under the Divorce, Dissolution and Separation Act 2020 allows couples, for the first time, to make joint applications to end their marriage.
Resolution Together is a way for separating couples who want to work together to manage their separation to instruct a single solicitor to provide advice.
It is suitable for those whose joint aim is to reach an outcome that meets their needs and the needs of any children involved.
How does it work?
- You and your former partner agree that you wish to work with one solicitor who will provide you with all the help and support you need to reach an outcome together.
- Your instructed solicitor will provide you with joint legal advice, which will focus on the best interests of your family as a whole rather than one party “winning” over the other.
- Your instructed solicitor will help you both in arranging other professionals to provide any other support or advice that you need. That might include financial advisers, accountants, family consultants, barristers and arbitrators who can provide a neutral evaluation of your situation and help with providing a binding outcome if and when you need it.
When is it not suitable?
Resolution Together is unlikely to be an appropriate route for you if: -
- Either you or your former partner are unable to disclose any information particularly in relation to finances.
- There have been or are any ongoing concerns of abuse within the relationship.
- There are any issues around mental or emotional health.
- You feel that you are unable to make your decisions freely.
